1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and Mustafa Kendigüzel ("Developer," "we," "us," or "our") concerning your access to and use of the ComicAI mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

5. User Content and AI-Generated Content

5.1 Your Input

You retain ownership of the text prompts, descriptions, and other content you provide to the App ("User Input"). By submitting User Input, you grant us a license to process it for the purpose of generating content.

5.2 AI-Generated Content

Content generated by the App using AI technology is provided for your personal use. You may use the generated content for personal, non-commercial purposes. We make no guarantees about the uniqueness, accuracy, or quality of AI-generated content.

5.3 Content Restrictions

You agree not to use the App to create content that:

6. Payments and Subscriptions

6.1 In-App Purchases

The App may offer in-app purchases, including subscriptions and credit packs. All purchases are processed through Apple App Store or Google Play Store and are subject to their respective terms and policies.

6.2 Subscriptions

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your device's app store settings.

6.3 Refunds

Refunds are handled by the respective app store (Apple or Google) in accordance with their refund policies. Please contact the app store directly for refund requests.

6.4 Credits

Credits purchased or earned through the App are non-transferable and non-refundable. Unused credits may expire as specified in the App.

7. Intellectual Property

The App, including its design, features, code, graphics, and AI technology, is owned by Mustafa Kendigüzel and protected by intellectual property laws. "ComicAI" and related logos are trademarks of the Developer.

Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without prior written consent.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL ARISING FROM YOUR USE OF THE APP.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the past twelve (12) months, or $100, whichever is greater.

You agree to indemnify and hold harmless Mustafa Kendigüzel from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

You may stop using the App at any time. Sections that by their nature should survive termination shall survive (including intellectual property, disclaimers, limitation of liability, and indemnification).

12. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
